Spousal support can be confusing. North Carolina law provides for temporary spousal support (post-separation support) and permanent spousal support (alimony). The law also establishes procedures for requesting alimony or post-separation support. Failure to follow these procedures could have serious consequences on your financial support. Furthermore, there are also conditions, such as re-marriage or co-habitation of the spouse receiving support, which may result in the termination of alimony or post-separation support.

At an alimony hearing, the judge establishes the amount and duration of the obligation to pay alimony. Normally, alimony is terminated when the husband (payor) or wife (payee) dies, the wife re-marries, or the wife cohabitates. Alimony can also terminate at a time specified by the judge. Additionally, a wife entitled to receive alimony from her husband may also be entitled to receive attorneys fees from him; however, the amount of attorneys fees is in the discretion of the judge.
